These Terms define the rules applicable to access and use of the Horio mobile application.

By using the application, you accept these Terms of Use.

Horio is a time-tracking and personal organization application that allows users in particular to:

• record work and break schedules;
• review history and statistics;
• export certain data;
• optionally use cloud backup and synchronization across devices;
• access premium features depending on the selected offer.

Some features may depend on your device, operating system, internet connection or third-party services.

The application may be used:

• without an account, for local features available on the device;
• with an account, if you choose to enable sign-in and cloud synchronization.

Access to the service is provided for your personal, non-exclusive use.

You agree to provide accurate information when you choose to sign in or use a feature that requires personal data.

When you use sign-in through a third-party provider such as Google or Apple:

• you remain responsible for the use of your account and credentials;
• you must protect access to your device and account;
• you must notify us without delay of any unauthorized use known to you.

Cloud synchronization is optional. You acknowledge that:

• the data you choose to synchronize may be hosted by technical providers;
• you remain responsible for the content you store in the application;
• backup availability is based on a best-efforts obligation and may depend on third-party services.

Some features may be offered through in-app purchases or a premium subscription.

In that case:

• prices, durations, renewal conditions and cancellation terms are shown by the relevant store before purchase;
• payment is processed by Apple App Store or Google Play, not directly by Horio;
• renewal, cancellation and, where applicable, refund management mainly follow the rules of the relevant store and mandatory legal provisions.

Access to premium features may be suspended or limited if the store or technical provider indicates that no active entitlement is attached to your account.

You agree to:

• use the application in compliance with applicable laws and regulations;
• not attempt to gain fraudulent access to systems, accounts or third-party data;
• not disrupt the normal operation of the application;
• not massively extract content, decompile, reproduce or commercially exploit the application beyond what is permitted by law;
• not use the application in a way that infringes third-party rights.

You remain solely responsible for:

• the data you enter;
• the exports you generate;
• how you use the information and calculations provided by the application.

The data you enter into the application remains under your responsibility.

You grant the publisher, as well as technical providers strictly necessary for the service to operate, the non-exclusive right to host, store, transmit and process this data only to the extent necessary to perform the features you have enabled.

Processing of personal data is described in the Horio Privacy Policy, which forms an integral part of the applicable contractual framework.

The publisher strives to ensure application accessibility, without guaranteeing permanent availability or the total absence of errors.

The application may be:

• modified;
• updated;
• temporarily interrupted for maintenance;
• adapted for technical, legal or security reasons.

Certain features may evolve, be added or be removed.

Unless otherwise stated, the application, its structure, interface, texts, graphic elements, sounds, trademarks, logos and components are protected by intellectual property law.

Subject to third-party rights and libraries used under license, these elements may not be reproduced, adapted, distributed or exploited without the publisher’s prior written authorization, except where strictly permitted by law.

The application is provided “as is”, subject to mandatory legal warranties where applicable.

To the extent permitted by law, the publisher cannot be held liable for:

• temporary unavailability of the application;
• malfunctions attributable to your device, operating system, internet connection or a third-party service;
• data loss caused by mishandling, lack of backup, deletion of the application or an external event not attributable to the publisher;
• incorrect use or use contrary to the intended purpose of the application.

Horio is a personal time-tracking aid. Data, statistics, exports and calculations displayed by the application must be checked by the user before any administrative, contractual, payroll, tax, social or HR use. The application does not replace an official employer attendance system or legal, accounting, social or HR advice.

The publisher may suspend or limit access to all or part of the service in the event of:

• non-compliance with these Terms;
• abusive or fraudulent use, or behavior affecting service security;
• a legal obligation or request from a competent authority.

You may stop using the application at any time.

Given the current operation of the application:

• you may delete synchronized data associated with the application using the options available in the application or by contacting the publisher;
• if you want full deletion of the authentication account and any residual associated data, you should also contact the publisher at contact@tempstravail.com.

The application is not designed for use by young children. If you are a minor and the law of your country requires parental authorization for certain processing or digital services, you must obtain that authorization before using the relevant features.

These Terms may be amended at any time to take into account:

• service evolution;
• a legal or regulatory requirement;
• a technical or economic change.

The applicable version is the one published on the date of consultation. In the event of a substantial change, appropriate information may be provided by any useful means.

These Terms are governed by the law applicable at the publisher’s habitual place of residence, subject to mandatory consumer protection provisions applicable in your country of residence.

In the event of a dispute, the parties will first seek an amicable solution.

If no amicable resolution is found, the dispute will fall under the competent courts according to the applicable rules of law.
